Terms of Service (ToS)

Effective: September 11, 2026 | General Terms and Conditions governing the use of the Preds artificial intelligence text detection service.

1. Introductory Provisions and Definitions

1.1 Contracting Parties:

Any natural or legal person, or unincorporated business entity, registering to use or accessing the Service.

1.2 Subject of the Agreement:
These General Terms and Conditions (hereinafter: "ToS") govern the terms and conditions under which the Service Provider provides its Preds AI-powered text detection service (accessible at https://preds.hu, hereinafter: "Service").

1.3 Definitions:
Service: The Preds web application and API platform analyzing Hungarian texts via machine learning to determine whether content was authored by a human or synthesized by artificial intelligence.
User Account: A unique identity created upon registration granting access to the Service.
API Key: A unique secret token (format: sk_live_*) enabling programmatic API access tied to a User Account.
Detection / Verification: An individual text analysis transaction in which the Service generates an AI likelihood prediction.
Quota: The monthly allocation of detections or words available under an active subscription.
Credit: A prepaid accounting unit entitling the User to analyze a specific volume of text without expiration. As of September 11, 2026, 1 credit equals 1,000 words of text analysis (previously 10,000 characters).
Word: The base billing unit, determined according to two rules:
(1) Any sequence of characters delimited by whitespace counts as one word. Delimiters include spaces, line breaks, tabs, and all other blank characters, regardless of letters, numbers, or punctuation (e.g., "dog" = 1 word · "e-mail" = 1 word · "3.14" = 1 word · "---" = 1 word).
(2) Unbroken character sequences exceeding 30 characters count as multiple words, calculated by dividing the character count by 30 and rounding up (e.g., a 30-character string = 1 word; a 31-character string = 2 words; a 90-character URL = 3 words). This ensures accounting reflects actual computational processing overhead.

1.4 Scope of the ToS:
These Terms apply to all visitors and users of the Service, including unauthenticated visitors, free tier users, credit pack holders, and paid subscribers. By using the Service, registering an account, or making a purchase, the User unconditionally accepts these Terms.

2. Conclusion and Duration of the Contract

2.1 Formation of Contract:
The contract is concluded upon User registration and successful email verification. During registration, the User explicitly accepts these Terms, the Privacy Policy, and consents to data processing.

Registration is available via:
Email and password, subject to verification link confirmation, or
Google Account ("Continue with Google"), where the verified email provided by Google serves as confirmed without a separate confirmation email.

Accounts created via Google Sign-In are legally equivalent in all respects to accounts registered via email and password.

2.2 Age Limits and Legal Capacity:
The Service is accessible to users aged 10 and older:
Users aged 16 or older may enter into this agreement independently.
Users aged 10 to 15 may use the Service only with verifiable parental or legal guardian consent. By registering, the User represents that they possess such consent.
Children under 10 years of age are prohibited from registering or using the Service.

2.3 Contract Duration:
Free Tier: Concluded for an indefinite duration upon registration; terminable by either party at any time without justification. Includes 3 free detections daily.
Credit Packs: Concluded upon completed payment; remains valid until credits are exhausted. Credits have no expiration date.
Subscriptions (Essential, Pro, Max): Auto-renewing recurring contract on a monthly or annual billing cycle until cancelled.

2.4 Mandatory Registration:
Access to text detection requires registration. Detection cannot be performed without an active account.

2.5 Email Verification:
Verification of the provided email address is required. Unverified accounts may be automatically purged after a reasonable grace period.

2.6 Single Account Limitation:
Only one active account may be registered per email address. Creating multiple accounts to circumvent daily free quotas is strictly prohibited.

3. User Accounts and Credentials

3.1 Registration Requirements:
Users must provide accurate, current, and complete details during registration (valid email, first name, last name, and password with a minimum of 10 characters).

3.2 User Obligations:
• Safeguard login credentials and never share them with unauthorized parties.
• The User is solely liable for all activities conducted through their account or API keys.
• Promptly report any suspected security breach or unauthorized access to [email protected].

3.3 Authentication & Session Security:
• Automated risk-based verification: unfamiliar IP addresses or devices may trigger email verification codes.
• Users may review and revoke active sessions from account Settings.

3.4 Password Policies:
• Stored using one-way cryptographic salting and hashing.
• Password reset links are time-limited and single-use.

3.4/A Google Sign-In Provisions:
• Google-authenticated accounts do not initially require a password; a password may be added anytime via the reset mechanism.
• Users are solely responsible for the security of their underlying Google account.
• The Service Provider is not liable for service disruption caused by Google account suspensions or outages.

3.5 API Key Governance:
• API keys are stored in hashed format and shown only once upon creation.
• The User may generate multiple keys and revoke them individually.
• Keys inherit the rate limits and quotas of the User's active subscription tier.

3.6 Account Suspension and Deletion by Provider:
The Service Provider reserves the right to suspend or terminate accounts without prior notice in cases of material breach, security threats, fraudulent registration, or abuse of the free quota.

4. Acceptable Use and Restrictions

4.1 Permitted Use Cases:
The Service may be used strictly for lawful purposes, including:
• Academic integrity verification of student coursework and essays
• Publishing and editorial quality assurance of submitted manuscripts
• Enterprise verification of AI-generated content
• Scientific and linguistic research

4.2 Prohibited Activities:
Users shall not:
• Perform vulnerability testing, reverse engineering, or penetration tests without prior written consent
• Overload infrastructure using unauthorized automated bots or scrapers
• Disrupt other users' access to the Service
• Process illegal, defamatory, or copyright-infringing content
• Use the Service to train or benchmark directly competing AI text detectors
• Attempt to bypass rate limits or quota mechanisms

4.3 Privacy & Sensitive Data:
• Users must comply with GDPR and applicable privacy legislation.
• Uploading special category data (health, biometric, criminal records) of third parties without a valid legal basis is strictly prohibited.

5. Scope of Service and Performance

5.1 Service Tiers:

Free Tier:
• 3 daily detections, resetting at 00:00 UTC daily.
• Unused daily allowance does not roll over to subsequent days.
• Web interface and API access, history storage, email support. No uptime SLA.

Credit Packs (One-Time Purchase):
• Available packs: 500, 2,000, or 5,000 credits.
• 1 credit = 1,000 words.
No expiration date; valid indefinitely until consumed.

Subscriptions (Essential, Pro, Max):
• Monthly or annual billing cycles (annual billing includes 2 months free / 10 monthly price).
• Monthly quotas reset at the end of each billing cycle; unused quotas do not roll over.
• Shared quota across web and API access.
• Priority customer support on Pro and Max tiers.

5.2 Service Availability:
• The Service is operated with high availability targets, but 100% uninterrupted uptime is not guaranteed (absent a separate Enterprise SLA agreement).
• Scheduled maintenance is announced in advance where feasible; emergency patches may occur without advance notice.

5.3 Detection Accuracy & Probabilistic Nature:
The Service does not guarantee 100% accuracy. Machine learning detections represent probabilistic assessments provided "AS IS".
• False positives and false negatives may occur. Detection scores must be interpreted with critical human judgment in context.
• Decisions with significant legal or personal consequences (academic disciplinary action, employment termination) must never be based solely on automated detector outputs without substantive human review.
• The Service is tuned specifically for the Hungarian language.

5.4 Technical Input Limits:
• Minimum text length for API detection: 60 words
• Maximum text length: 1,000,000 characters
• Supported formats: TXT, PDF, DOCX, Markdown
• Document OCR: scanned PDF up to 120 MB and 500 pages
• Handwriting OCR: image up to 8 MB and 16 megapixels (Section 5.7)
• Batch API: up to 20 documents per request

5.5 Rate Limiting:
Dynamic rate limits protect system performance. Exceeding limits returns HTTP 429 with retry headers.

5.6 Data Storage & Retention:
• Data is stored in secure Hetzner Online GmbH data centers within the EU.
• Submitted texts and analysis metadata are stored in encrypted form to provide history, audit trails, and dispute resolution.

5.7 Handwriting OCR Functionality:
• Optical character recognition for handwritten text is provided via Google Ireland Limited's Gemini API.
• Accuracy is provided "AS IS" and depends on image clarity and legibility. The User warrants that uploaded images do not violate third-party rights.

6. Fees, Payment Terms and Invoicing

6.1 Pricing and Currency:
• Current rates are published at https://preds.hu/pricing.
• All prices are quoted in Hungarian Forint (HUF) as gross totals.
The Service Provider is a small enterprise exempt from VAT ("alanyi áfamentes") under Section 187 of the Hungarian VAT Act; therefore, prices do not include VAT, and no VAT is charged.
• Notice of price changes is given at least 30 days in advance via email; price changes take effect in the next billing cycle.

6.2 Payment Methods:
Card payments via Stripe: Processed securely through Stripe; Preds does not store card credentials.
• Recurring subscription charges renew automatically unless cancelled prior to renewal.

6.3 Payment Failures:
• Stripe Smart Retries will attempt payment up to 3 times upon failure. If unpaid, the subscription is suspended.

6.4 Upgrades and Cancellations:
• Upgrades take effect immediately with proration.
• Cancellations take effect at the conclusion of the current prepaid billing period.

6.5 Refund Policy:
Subscriptions: Ordinary cancellation takes effect at period end; no prorated refunds for elapsed periods except where mandated by law.
Credit Packs: Consumers are entitled to statutory withdrawal within 14 days of purchase with a proportional refund for unused credits pursuant to Section 11.6.

6.6 Invoicing:
• Compliant electronic invoices marked "alanyi áfamentes" are delivered via email within 8 days of payment.

6.7 Clerical Errors:
• In cases of obvious system pricing errors (e.g. 0 HUF subscriptions due to system defects), orders may be corrected or cancelled without liability.

7. Liability and Indemnification

7.1 Disclaimer of Consequential Damages:
To the fullest extent permitted by applicable law, the Service Provider shall not be liable for indirect, incidental, punitive, or consequential damages, lost profits, lost data, business interruptions, or decisions made on the basis of detection outputs.

7.2 Maximum Liability Cap:
For non-consumer users, total aggregate liability arising out of this agreement is capped at the total amount actually paid by the User to the Service Provider in the preceding 12 months, except in cases of intentional misconduct or gross negligence.

7.3 User Indemnification:
The User agrees to indemnify and hold harmless the Service Provider against any claims, losses, or legal costs arising from unlawful content uploaded by the User, breach of third-party IP rights, or breach of these Terms.

7.4 AS IS Provision:
The Service is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, whether express or implied. Mandatory consumer statutory rights remain unaffected.

8. Intellectual Property

8.1 Provider Intellectual Property:
All software, neural architectures, weights, algorithms, web designs, trademarks, logos, and documentation comprising Preds remain the exclusive property of the Service Provider.

8.2 Limited License:
The Service Provider grants the User a non-exclusive, non-transferable, revocable license to access and use the Service in compliance with these Terms.

8.3 User-Submitted Content:
• Intellectual property rights in texts submitted by the User remain with the User or their respective rights holders.
• The User grants the Service Provider a limited license to process, normalize, and encrypt text for detection and history maintenance.
• The Service Provider never sells user texts or transfers them to third parties for marketing.

9. Termination of Agreement

9.1 Termination by the User:
Free Tier: Terminable at any time by deleting the account.
Subscriptions: Terminable anytime via Dashboard → Billing; remains active until the end of the paid billing cycle.

9.2 Termination by the Service Provider:
The Service Provider may terminate the contract with immediate effect and suspend the User Account in case of material breach, abusive rate limit tampering, fraud, or repeated payment failure.

9.3 Account Deletion:
Initiated via Dashboard → Settings → Delete Account or by emailing [email protected]. An email verification code is required.

9.4 Post-Termination Data Schedule:
• Profile, session tokens, API keys, and encrypted texts are purged immediately upon deletion.
• Analytical metrics and access logs are purged within 30 days.
• Invoices and accounting records are retained for 8 years as required by Hungarian law.
• A one-way cryptographic hash of the user's email is retained for 30 days solely to prevent abuse of the daily free credit quota.

9.5 Pre-Deletion Data Export:
Users may download a comprehensive JSON/ZIP export of their account history pursuant to GDPR Article 20 prior to deleting their account.

10. Data Protection

Detailed terms governing the collection and processing of personal data are set out in the Preds Privacy Policy: https://preds.hu/privacy.

Personal data is processed in strict compliance with the GDPR (Regulation (EU) 2016/679) and Hungarian Act CXII of 2011 (Infotv.). Submitted texts are stored in encrypted format as a contractual necessity to deliver the Service. Personal data is never sold to third parties.

11. Dispute Resolution and Governing Law

11.1 Governing Law:
These Terms and all agreements between the parties shall be governed by and construed in accordance with the laws of Hungary, in particular the Hungarian Civil Code (Act V of 2013), Act CVIII of 2001 (e-commerce), Act CLV of 1997 (consumer protection), and Government Decree 45/2014 (distance contracts).

11.2 Amicable Resolution:
The parties agree to make good-faith efforts to resolve any disputes amicably by writing to [email protected] or [email protected].

11.3 Competent Jurisdiction:
For Consumers: The court of the consumer's domicile or habitual residence holds jurisdiction.
For Business Entities: The courts having jurisdiction over the Service Provider's registered seat (Kecskemét Regional Court) shall have exclusive jurisdiction.

11.4 Conciliation Board (Consumer Disputes):
Consumers may initiate out-of-court dispute resolution before the competent Hungarian conciliation board:

11.5 Consumer Protection Authority:
Consumers may lodge complaints with the National Authority for Trade and Consumer Protection (NKFH): https://nkfh.gov.hu/

11.6 Statutory 14-Day Right of Withdrawal (Consumers Only):
Consumers have the right to withdraw from a distance purchase within 14 days without giving any reason pursuant to Government Decree 45/2014.
• For credit packs, consumers exercising this right receive a proportional refund for unused credits (e.g., if 70% of credits were consumed, a 30% refund is issued).
• Notice of withdrawal may be sent to [email protected] using the model withdrawal form in Annex 1. Approved refunds are issued within 14 days to the original payment method.

12. Miscellaneous Provisions

12.1 Amendments to the ToS:
• The Service Provider may unilaterally amend these Terms for legitimate reasons (regulatory changes, technical enhancements, third-party vendor price changes, system security).
• Non-detrimental changes take effect upon publication.
• Detrimental changes (quota reductions, price increases) are subject to 30 days advance notice via email and dashboard announcements.
• Users not wishing to accept detrimental changes may terminate their contract with immediate effect before the change takes effect, receiving a proportional refund for unused paid services.
• Ongoing prepaid billing cycles are grandfathered until their renewal date.

12.2 Force Majeure:
Neither party shall be liable for delays or failures caused by events beyond reasonable control (natural disasters, war, cyber warfare, national telecommunication failures).

12.3 Severability:
If any provision of these Terms is found invalid or unenforceable, the remaining provisions shall continue in full force and effect.

12.4 Notices:
Notices sent to the User's registered email address are deemed officially served.

14. Acceptance of Terms

By completing registration or purchasing services, the User confirms that they have read, understood, and agreed to these Terms and the Privacy Policy, and accepts the probabilistic nature and limitations of AI detection.

Effective Date:
These Terms are effective as of September 11, 2026.

15. Transitional and Final Provisions

15.1 Change of Accounting Unit (Characters to Words):
Effective September 11, 2026, the billing unit transitioned from character-based to word-based accounting: 1 credit equals 1,000 words instead of the former 10,000 characters, reflecting actual LLM computation overhead.

15.2 Balance Doubling Adjustment:
To protect existing customers, all unused credit balances and ongoing subscription monthly quotas were doubled (1 : 2 ratio) on September 11, 2026, rounded up in the user's favor.

15.3 Plan Quota Revisions:
Package quotas are revised effective October 15, 2026. Existing prepaid cycles remain unaffected until renewal.

16. Organization Accounts and Enterprise Single Sign-On (SSO)

This Section 16 governs institutional, academic, and enterprise accounts.

16.1 Definitions:
Organization: The legal entity (enterprise, school, university) establishing a workspace.
Organization Account: A member account tied to the organization pool.
Administrator: Appointed manager managing members, limits, and SSO settings.
Identity Provider (IdP): SAML 2.0 system (Microsoft Entra ID, Okta, Google Workspace).

16.2 Institutional Responsibility:
• The Organization warrants it holds a lawful legal basis under GDPR to submit texts (including student coursework or employee documents) for detection.
• The Organization agrees to indemnify the Service Provider against third-party claims arising from workspace content.

16.3 Administrator Access & Content Visibility:
• Administrators see member names, emails, roles, quotas, and audit logs.
Content Access: Access to view member submitted texts is disabled by default and can only be enabled by explicit administrator setting.

16.4 Enterprise SAML 2.0 SSO:
• Preds supports SAML 2.0 identity federation.
• The Service stores solely the pseudonymous NameID assertion. No auto-provisioning occurs without prior assignment.
• In case of IdP lockouts, an emergency recovery flow is available upon verified request.

16.5 Append-Only Audit Log:
Workspaces maintain an immutable, exportable audit trail of administrative actions.

16.6 Data Processing Addendum (GDPR Article 28):
For texts analyzed in Organization Workspaces, the Organization acts as Data Controller and the Service Provider acts as Data Processor pursuant to Annex 2 below.

ANNEX 2 – Data Processing Addendum (GDPR Article 28)
1. Subject Matter & Scope: Processing submitted documents solely to perform AI detection and OCR on behalf of the Organization for the duration of the workspace.
2. Documented Instructions: Processing occurs strictly pursuant to documented instructions in these Terms and workspace configurations.
3. Confidentiality: All personnel handling data are subject to binding confidentiality agreements.
4. Security: Industry-standard technical and organizational security controls (GDPR Art. 32).
5. Subprocessors: Authorized subprocessors listed in the Privacy Policy. 14 days advance notice for additions.
6. Data Subject Rights: Provider assists the Organization in fulfilling GDPR rights requests.
7. Breach Notification: Provider notifies the Organization without undue delay upon becoming aware of a personal data breach.
8. Data Deletion: Workspace data is exported or permanently deleted within 90 days of termination.
